What to Expect When You Work with Experienced Associates
If you're an experienced truck driver looking to move to the U.S. permanently, the EB-3 visa program is your legal path to a better future. At Experienced Associates, we guide you through every step – from employer interviews to final visa approval – ensuring your documentation is strong and your questions are answered.
Here’s what the process looks like from start to finish:
Step 1: Employment Verification
Before you're accepted into the program, we must verify your work history—not just for eligibility, but to meet government filing standards.
This includes:
At least 2 years of verifiable over-the-road (OTR) experience
A complete record of all employment for the past 10 years, including job titles, employers, and employment dates
Employer references, driving logs, and/or pay stubs when available
This information is required for the 9089 filing with the U.S. Department of Labor, so accuracy and completeness are essential.
Step 2: Document Gathering
Once you're pre-approved, our team will guide you through gathering required personal and legal documents, such as:
Valid passport
Birth certificate
Marriage certificate (if applicable)
Driver’s license or national certification
Resume and personal ID photos
We provide a detailed checklist and hands-on support so nothing gets missed.
Step 3: Employer Interview
You’ll meet with one of our trusted U.S. trucking partners for a formal job interview. This is a chance for them to confirm your skills and for you to ask about:
Work schedule
Pay structure
Driver expectations
If successful, you’ll receive a conditional job offer, which is the foundation for your visa case.
Step 4: Form 9089 (PERM Labor Certification)
With your job offer and verified documents in hand, our legal team submits Form 9089 to the U.S. Department of Labor.
This step confirms:
That there’s a real job available for you
That no qualified U.S. workers are being displaced
That your work history is consistent and verified
Timeline: About10–12 months, but it can take longer if audited.
Step 5: Form I-140 (Immigrant Petition)
After 9089 approval, we file the Form I-140 with U.S. Citizenship and Immigration Services (USCIS). This petition confirms:
Your employer's commitment to sponsor you
Your qualifications for the role
Your eligibility to immigrate under EB-3 status
You will also complete a medical exam and provide any additional requested evidence during this phase.
Timeline: About 6-12 months
Step 6: NVC Process (National Visa Center)
Once I-140 is approved, your case moves to the National Visa Center (NVC) for final processing and scheduling of your U.S. consulate interview.
You'll be asked to:
Upload civil documents (e.g., birth certificate, marriage license)
Complete a full personal history form (addresses, jobs, schools, etc.)
Schedule and complete your final consulate medical exam
Timeline: About18–24 months for interview scheduling, depending on your country of residence
Final Step: Receive Your Visa & Relocate
Once you pass your interview, the U.S. consulate will issue your immigrant visa. You’ll travel to the U.S., complete onboarding and training with your employer, and begin your new career.
Shortly after arrival, you’ll receive your Green Card, officially granting you permanent residency.
